Major issues in constitutional history.  Topics include: drafting the Constitution; the Bill of Rights; the Marshall era; the crises caused by slavery and emancipation; the rise of substantive due process; Holmes, Brandeis, and freedom of speech; the New Deal and the Roosevelt 'revolution'; the Warren Court, civil liberties, and civil rights; criminal justice and the right of privacy; abortion and affirmative action; the Court, the detainees, and the 'war on terrorism'. Course requirements: two take-home prelims and a take-home final.
