This course is designed to familiarize students with the law, policy, and practice of arbitration. Arbitration is the principal method of resolving disputes between unions and employers, securities brokers and their customers, and under international business agreements, and it has gained favor in many other areas, including consumer, employment, construction, and insurance disputes. This course will explore the doctrines governing arbitration, including arbitrability, arbitral due process, and judicial review of arbitration awards. The course will also explore the vigorous public policy debates that have developed around arbitration, particularly its use in consumer and employment contracts. In addition, this course will provide an introduction to the particular issues involved in the practice of arbitration and how they differ from litigation.
